These Terms of Service ("Terms") govern your access to and use of the Kormart mobile application, website, and related digital services (collectively, the "Platform") operated by KOR MART LIMITED ("Kormart", "we", "us", or "our"). By creating an account, completing identity verification, listing an item, purchasing an item, using Kormart Shield, using the "Call to Buy" feature, funding a wallet, or otherwise using the Platform, you agree to be bound by these Terms and any policies expressly incorporated into them. If you do not agree to these Terms, you must not use the Platform.
Kormart operates a multi-vendor marketplace platform that enables users to list, discover, purchase, and sell goods and access related transaction, payment, delivery, communication, and trust-protection services.
Kormart is a marketplace and technology platform. Unless expressly stated otherwise, Kormart does not own, sell, lease, manufacture, inspect, possess, or directly supply items listed by users.
Sellers are responsible for the accuracy, legality, ownership, authenticity, safety, quality, and condition of items they list on the Platform. Sellers must have the legal right to sell the listed item and must ensure that their listings comply with applicable laws and these Terms.
Kormart does not guarantee the authenticity, quality, safety, legality, ownership, or condition of any item listed by a user.
Unless expressly stated otherwise, transactions are entered into between the buyer and seller. Kormart provides the Platform and related transaction infrastructure and may facilitate communication, payment, delivery, identity verification, dispute handling, and other services depending on the transaction method selected by the parties.
You must provide accurate and complete information when creating and maintaining your account. Kormart may restrict access to certain features or require additional verification where reasonably necessary for security, fraud prevention, regulatory compliance, transaction risk management, or other legitimate operational purposes.
Kormart may require users to complete identity verification before accessing certain Platform functions, including listing items, purchasing through Kormart Shield, receiving certain payments, or withdrawing funds. Where applicable, identity verification may include Bank Verification Number (BVN) validation and biometric facial liveness verification through Kormart's designated identity-verification service providers.
The collection and processing of personal data for identity verification is governed by these Terms together with Kormart's Privacy Policy and applicable Nigerian data-protection requirements.
You must not register or operate an account using another person's identity, BVN, biometric information, financial information, or other credentials without lawful authorization. Providing false, misleading, stolen, or unlawfully obtained identity information may result in:
You are responsible for taking reasonable measures to protect your account credentials, device access, transaction PINs, passwords, and authentication codes. You must not share passwords, transaction PINs, OTPs, or other authentication credentials with another person.
Kormart will not be responsible for losses arising from unauthorized access caused by your failure to reasonably protect your credentials or device, except to the extent liability cannot lawfully be excluded.
Kormart Shield is Kormart's transaction-protection mechanism designed to facilitate the secure processing and conditional release of funds in eligible transactions. Kormart Shield is available only when the applicable transaction is completed through the designated Kormart Shield payment flow.
When a buyer purchases an item using Kormart Shield, the buyer's payment is processed through Kormart's financial integration infrastructure and secured in accordance with the applicable payment arrangements. Funds are not released to the seller until the applicable contractual milestones or transaction conditions have been satisfied and verified in accordance with these Terms.
The specific financial institution, payment service provider, or other regulated financial partner involved in processing or safeguarding transaction funds may be identified within the applicable transaction flow or related documentation.
Subject to these Terms and any applicable dispute, refund, fraud, or compliance review, funds may be released to the seller when one of the following occurs:
Kormart may delay release where reasonably necessary to investigate suspected fraud, unauthorized activity, payment reversals, regulatory concerns, technical issues, or other material transaction risks.
Kormart may temporarily restrict wallet activity, delay withdrawals, suspend transactions, or place funds under review where reasonably necessary for:
Where permitted, Kormart will seek to resolve applicable restrictions within a reasonable period based on the circumstances of the case.
Applicable transaction fees, Kormart Shield fees, withdrawal fees, delivery charges, commissions, and other Platform charges will be displayed through the Platform where applicable. Fees may change from time to time. The applicable fee presented to you at the time of a transaction will generally apply to that transaction unless otherwise stated. Fees already incurred in connection with a completed service may be non-refundable, subject to applicable law and any specific refund policy.
Kormart may provide a "Call to Buy" option for listings where the buyer and seller choose to communicate and arrange the transaction directly. When a buyer selects "Call to Buy":
Kormart does not guarantee or assume responsibility for the outcome of a Call to Buy transaction, including the seller's receipt or delivery of payment, delivery of the item, item condition, authenticity, ownership, or performance of either party.
Users who wish to receive Kormart Shield transaction protection must complete the purchase through the applicable Kormart Shield-protected transaction flow on the Platform.
Where a buyer and seller choose to complete a transaction outside Kormart Shield, the resulting transaction is treated as a direct transaction between the parties.
Payment and delivery are arranged directly with the seller. Kormart Shield (Buy Safely) escrow protection does not apply to off-platform transactions.
Kormart will not be responsible for losses arising from a direct or off-platform transaction that was not processed through Kormart Shield, except to the extent liability cannot lawfully be excluded.
Users must not represent an off-platform transaction as a Kormart Shield-protected transaction or falsely claim that Kormart has secured, guaranteed, or approved funds relating to such a transaction.
Kormart may provide educational warnings and transaction-safety information to users who choose direct transactions.
Kormart does not require users to use Kormart Shield for every transaction unless the applicable listing or transaction flow expressly states that Kormart Shield is required.
Unless otherwise stated in a listing, promotion, or transaction agreement, delivery and courier charges are the buyer's responsibility.
Where a Kormart-integrated logistics provider is selected:
Where the integrated logistics provider reports an order as delivered, Kormart may begin an applicable inspection and dispute period. Unless otherwise stated for a particular transaction, the Platform may automatically release applicable Kormart Shield transaction funds to the seller when the designated inspection/dispute period expires without a valid dispute being submitted.
Kormart may delay automated release where there is credible evidence that the delivery status is inaccurate, disputed, fraudulent, or otherwise requires review.
Where a buyer and seller using Kormart Shield choose to arrange delivery independently of Kormart's integrated logistics infrastructure, Kormart may not have access to independent courier tracking, delivery verification, or transit records. In such circumstances, users are responsible for retaining appropriate delivery and receipt evidence.
Kormart may nevertheless review a dispute using any reliable evidence submitted by the parties.
For transactions initiated through the Call to Buy feature, delivery and fulfillment arrangements are made directly between the buyer and seller. Kormart's Kormart Shield inspection, dispute, escrow, automated-release, refund, and transaction-protection mechanisms do not apply unless the parties subsequently complete the transaction through an available Kormart Shield-protected payment flow.
Any payment, delivery, inspection, return, refund, or other arrangement made directly between the buyer and seller is the responsibility of the parties involved.
Buyers should inspect items promptly upon delivery. For consumer electronics, smartphones, computers, and other higher-value or condition-sensitive items, buyers are strongly encouraged to record continuous, unedited unboxing and basic testing video evidence where reasonably practicable.
Failure to provide such evidence may affect Kormart's assessment of a dispute, but does not automatically prevent a buyer from submitting other relevant evidence.
Once a buyer confirms receipt and acceptance of an item, or the applicable inspection/dispute period expires without a valid dispute, the transaction may be treated as completed and the applicable funds may be released.
A completed transaction will generally not be reopened through the Platform except where required by applicable law or where Kormart determines that exceptional circumstances, fraud, unauthorized activity, material error, or another significant issue warrants further review.
A buyer or seller may initiate a dispute within the applicable transaction dispute period specified by the Platform for a Kormart Shield-protected transaction.
Call to Buy and other off-platform transactions are not covered by Kormart Shield's dispute process unless the parties subsequently complete an eligible Kormart Shield-protected transaction.

Users must provide requested evidence within the timeframe specified by Kormart. Failure to provide requested evidence may negatively affect the outcome of the dispute where the missing evidence is relevant to determining the matter.
Kormart may review disputes based on the information and evidence available to it. Kormart may determine an appropriate operational outcome, which may include:
Kormart's internal dispute determination will govern the release, refund, or distribution of funds within the Platform, subject to any rights and remedies available to users under applicable law.
Where a dispute requires an item to be returned, Kormart may specify the return procedure and applicable timeframe. Unless otherwise determined by Kormart or required by applicable law, the buyer may initially be responsible for return delivery costs.
Where a seller is determined to have engaged in deliberate fraud, counterfeit distribution, or material misrepresentation, Kormart may seek to recover applicable return or related costs from the seller's available Platform balance, subject to applicable law.
Nothing in these Terms is intended to prevent a user from exercising a legal right or remedy that cannot lawfully be waived or restricted under applicable law.
Users must not list, advertise, sell, purchase, or otherwise facilitate transactions involving prohibited or unlawful goods or activities. Prohibited categories include, without limitation:
Kormart may remove prohibited listings, restrict accounts, suspend transactions, restrict wallet activity, and report suspected unlawful activity to appropriate authorities where required or permitted by law.
Where funds are subject to a lawful freeze, investigation, regulatory requirement, court order, or other legal process, Kormart may restrict access to those funds in accordance with the applicable requirement.
If a payment is reversed, recalled, charged back, or otherwise invalidated after funds have been released to a seller, Kormart may seek recovery of the resulting amount from the responsible user. Where permitted by law and the applicable financial-provider arrangements, Kormart may place an appropriate negative balance or restriction on the user's Kormart account while the amount remains outstanding.
Kormart may pursue lawful recovery mechanisms for unpaid amounts.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Kormart, its directors, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, and reasonable expenses arising from:
This indemnity does not apply to losses caused by Kormart's own conduct to the extent that such liability cannot lawfully be excluded or transferred.
To the maximum extent permitted by Nigerian law, Kormart will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Platform, including loss of profits or business opportunities, except where such liability cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Kormart may suspend, restrict, or terminate an account where reasonably necessary because of:
Where appropriate and legally permissible, Kormart may provide notice or an opportunity to resolve the issue.
Users may request deletion of their Kormart account in accordance with the Platform's account-deletion process. Account deletion does not automatically terminate ongoing transactions, disputes, investigations, chargebacks, financial obligations, or legal proceedings.
Kormart may retain information for as long as reasonably necessary to complete transactions, resolve disputes, prevent fraud, comply with legal or regulatory obligations, establish or defend legal claims, or satisfy other lawful retention requirements. Any retained personal data will continue to be handled in accordance with Kormart's Privacy Policy and applicable data-protection requirements.
Kormart collects and processes personal information necessary to operate the Platform, provide transaction services, verify identities, prevent fraud, process payments, provide customer support, improve the Platform, and comply with applicable legal and regulatory requirements.
The categories of information collected, purposes of processing, lawful bases, retention periods, data-sharing arrangements, user rights, security measures, and other privacy matters are described in Kormart's Privacy Policy.
Where Kormart uses third-party service providers for identity verification, payments, logistics, hosting, analytics, customer support, or other Platform functions, applicable information may be shared with those providers to the extent necessary to provide the relevant service or comply with applicable requirements.
Users should review Kormart's Privacy Policy before using the Platform.
Kormart owns or licenses the intellectual property associated with the Platform, including its software, branding, logos, design, trademarks, and proprietary technology, except for third-party materials and user-generated content.
Users may not copy, reproduce, modify, distribute, reverse engineer, sell, or commercially exploit Kormart's proprietary Platform materials without prior authorization.
By submitting content to Kormart, including listings, photographs, descriptions, and reviews, you grant Kormart a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt that content as reasonably necessary to operate, promote, and improve the Platform, subject to applicable law and the Kormart Privacy Policy.
Kormart does not guarantee that the Platform will always be available, uninterrupted, error-free, or free from technical failures.
The Platform may depend on third-party services, including financial institutions, payment service providers, identity-verification providers, logistics providers, hosting providers, telecommunications networks, and other technology providers.
Kormart is not responsible for failures caused by third-party services outside Kormart's reasonable control, subject to any liability that cannot lawfully be excluded.
Kormart may update these Terms from time to time to reflect changes to the Platform, business operations, applicable law, regulatory requirements, or user protections.
Where appropriate, Kormart will provide notice of material changes through the Platform or other reasonable means.
Your continued use of the Platform after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
If you do not agree with a material change, you should stop using the affected Platform services.
These Terms are governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.
Subject to any mandatory rights or remedies available under applicable law, disputes concerning these Terms or use of the Platform will be handled through Kormart's applicable internal dispute-resolution process and, where necessary, the appropriate courts or other lawful dispute-resolution mechanisms in Nigeria.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permissible.
The remaining provisions will continue in full force and effect.
These Terms, together with Kormart's Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement governing your use of the Platform.
Where a specific transaction contains additional terms displayed or agreed through the Platform, those transaction-specific terms will apply to the relevant transaction to the extent they are consistent with these Terms and applicable law.
For questions, complaints, disputes, or other matters concerning these Terms or the Platform, users may contact Kormart through the official support channels provided within the Platform or on Kormart's official website.
